TERMS AND CONDITIONS (T&C's)

1. Duration and location of the exhibition
The SWISS CLASSIC WORLD 2024 will take place over 3 days at the exhibition grounds of Messe Luzern AG in Lucerne (Allmend).
2. Registration and Confirmation
By returning the fully completed and signed exhibitor contract (2 pages), you confirm your participation and fully acknowledge these general terms and conditions. The conditions are binding. Reservations, additions or the like will not be considered/accepted.
Upon receipt of the registration, you will receive a written or, if necessary, verbal confirmation from us, which establishes a contract. If you are accepted, you will also receive a stand confirmation after planning/assignment. The acceptance only applies to the registered company (hereinafter referred to as "exhibitor"), its services, the registered products, and the registered co-exhibitors. As the contract partner/exhibitor, you are obligated to display and exhibit these services and registered products, including those of the co-exhibitors, throughout the entire duration of the fair and to keep the stand continuously staffed. Furthermore, the exhibitor is required to set up, dismantle, and vacate the stand within the general time limits and to leave the stand space in good condition. Failure to meet these obligations gives the fair management the right to take all appropriate measures at the expense and risk of the exhibitor.
To include other companies ("co-exhibitors"), services, or products at the exhibitor’s stand (also known as "subtenants"), the exhibitor must obtain prior written approval from the exhibition management. If written consent is granted, it is the exhibitor's responsibility to charge the co-exhibitor for any additional costs, such as extra exhibitor passes ordered by the co-exhibitor. Additionally, the exhibitor must inform the co-exhibitor of their rights and obligations, such as deadlines for catalogue entries, industry directories, and these terms and conditions (AGB). The fair management will only invoice the main exhibitor.
3. Co-Exhibitors
The participation of co-exhibitors requires a separate registration and corresponding approval from the fair management. Co-exhibitors (or "subtenants") are companies that in any way appear at an exhibitor's stand, whether through address or signage, services, products, or promotional materials. For each co-exhibitor, the exhibitor must pay a base fee of CHF 420.00, which includes the cost of the mandatory entry in the exhibitor directory.
4. Approval
Companies whose exhibition goods correspond to the theme of the event (i.e., classic vehicles or vintage cars) are eligible to exhibit. The exhibition management will decide on the admission of a company, its services, or a product, as well as the placement of exhibitors and any potential co-exhibitors.
5. Exhibition Space & Stand Construction
The rented stand area includes the floor space, general hall lighting and air conditioning, nightly cleaning of the corridors, forecourts, and sanitary facilities, as well as the final cleaning of the halls and outdoor areas.
Not included in the rental price are:
– Floor covering (mandatory in Hall 1, 2 and 4)
– Any possible additional frontage surcharges and extra floors
– Booth construction and booth equipment
– Booth boundary (walls) to the neighboring booth
– Cleaning of one's own exhibition booth
– Technical connections as well as fees and consumption
– Fees for co-exhibitors
– Ads in the trade fair directory & promotional material
– Other rentals, additions, and services that are requested with special order forms
– Insurances
– Ancillary and disposal costs
A surcharge of 50% on the square meter price will be applied for the walkable area of additional floors.
Third-party services such as booth construction, booth equipment, plants, insurance, etc., will be invoiced directly by the appointed suppliers.
The exhibitor rents the bare booth space without booth construction and/or flooring (unless already included in the booth rental). They may (but are not required to) arrange booth construction/equipment through the official booth builder, whether with a standard booth or with a custom booth concept.
All booth constructions, including hanging elements, must comply with the specific regulations of the Messe Luzern AG operating rules as well as fire safety requirements. For additional floors, prior approval must be obtained from the trade exhibition management. No customs or other fees for deliveries will be covered by the trade fair management.
Encroachments beyond the ordered space will be charged at CHF 50.00 per square meter. If the booth construction, any part of it, or an exhibit is not approved by the fire department or Messe Luzern AG, the trade fair management cannot be held liable. It is the responsibility of the exhibitor to make the necessary preliminary inquiries.
The hall floor at Messe Luzern is specially sealed and must not be covered, taped, scratched, or otherwise damaged with unsuitable materials (e.g., adhesive tape, films, etc.). Prior permission from Messe Luzern or the trade fair management must be obtained before using adhesive strips, adhesive films, or similar materials.
6. Exhibition goods
The registration must precisely include the exhibition items and themes to be displayed at the booth. The exhibited items must fully comply with and meet the standards of SWISS CLASSIC WORLD. This means that the exhibited items should be classic vehicles or vintage cars or related to this theme. Inappropriate items or items not registered may be removed from the booth by the trade fair management at the exhibitor’s expense and risk, even after the fair opens. This is particularly applicable if misleading information (e.g., general terms) is provided. Exhibitors who are not manufacturers themselves must label their products with exact details about the manufacturer, including the address and type of exhibited items.
7. Booth order and booth allocation
The trade fair management strives to accommodate requests for location and booth size, considering the industry allocation of the halls and, if applicable, the outdoor area. Booth allocation is based on the information provided by exhibitors during registration. Variations due to planning reasons should be expected. The overall trade fair appearance is decisive. You will receive a plan with the assigned booth along with the official admission confirmation. Objections must be communicated to the trade fair management by registered mail within 5 days of the dispatch of the final hall plan; otherwise, the allocation is considered accepted. The trade fair management is entitled, if necessary, to assign the exhibitor a different location from that previously confirmed. Furthermore, the trade fair management is authorized to alter the size and dimensions of the booth, relocate or close hall or outdoor area entrances, and make other structural changes. The trade fair management is not liable to the exhibitor for any consequences arising from the location or surroundings of their booth.
8. Sales regulations / Permissions
Direct sales of goods are permitted in accordance with the closing regulations of the city of Lucerne. The exhibitor is required to obtain the necessary official permits for the trade fair/exhibition and to comply with legal regulations. The trade fair management does not assume any liability on the part of the exhibitor. The exhibitor is responsible for obtaining any necessary permits for conducting raffles and competitions within their own booth. The trade fair management will not be liable for any official prohibitions on advertising or sales. Any taxes and fees for permits will be charged additionally to the exhibitor.
9. Booth activities, advertising, seminars, and noise control
Any sound amplification, voice amplifiers, background music, booth parties, as well as show and action performances, among other things, must be approved by the trade fair management through a written concept. Anyone who plays or plays back live music or music from sound or audiovisual recordings in the premises or on the grounds of Messe Luzern is obligated, under existing state agreements, to notify the trade fair management at least 30 days before the start of the fair. The trade fair management will submit all permits to the Swiss Society for the Rights of Authors of Musical Works (SUISA) and pay the fees. The exhibitor will be charged a processing fee of CHF 50.00 as well as the SUISA fees. The trade fair management does not recognize any third-party claims arising from non-compliance with copyright regulations. Even with approval, the trade fair management reserves the right to withdraw the permission, especially if co-exhibitors feel disturbed in their consultation and sales conversations.
In particular, the use of space around the booth is not permitted. The area outside the booth space may not be used for advertising purposes. Distributing promotional materials outside the own booth area is prohibited without written permission from the trade fair management. After a single warning, the organizer reserves the right to prohibit the presentation, disconnect the power supply, or if necessary, close the booth. The relevant legal requirements must be adhered to.
10. Catering/food sales and tastings
Messe Luzern is responsible for catering across the entire trade fair grounds. The exclusive catering partner is Tavola Catering, operated by Tavolago AG. Furthermore, the regulations of the cantonal food ordinances must be adhered to. These regulations also apply to pure tasting activities where food and/or beverages are provided free of charge. The trade fair management does not cover any costs for possible fines or additional expenses.
11. Waste disposal / Disposal costs
Any waste generated during the setup or dismantling of the booth must be removed by the exhibitor. The disposal of waste left on the trade fair grounds is subject to a fee. Disposable carpets must be disposed of by the exhibitors themselves. During the fair, the trade fair management charges a disposal fee of CHF 4.00 per square meter. This fee will be billed to all exhibitors in the halls.
12. Exhibitor consent
The exhibitor grants the trade fair management full and irrevocable rights to take photographs, drawings, and film recordings, as well as conduct interviews, etc., of the trade fair and exhibitor/exhibition activities, of the constructions and booths, and the exhibited items and services, among other things. The trade fair management can use this material freely for advertising, press publications, and similar purposes, without the exhibitor being able to raise any objections or derive rights from it for any reason. This also applies to recordings/interviews, etc., made directly by the press or television with the exhibitor's consent.
13. Insurance / Insurance obligation / Liability
The trade fair management takes out liability insurance for claims from third parties (visitors, etc.). This insurance does not cover the personal liability of the exhibitors and their staff. The trade fair management does not take out insurance for the exhibitors. Exhibitors are therefore required to obtain their own liability insurance and provide a copy of the policy to the trade fair management upon request. The exhibitor bears all consequences resulting from the failure to obtain the mandatory exhibition insurance. The exhibitor is also required to install safety devices (including drip protection) on their exhibited and operational machines and equipment. The exhibitor is liable for any personal and property damage resulting from the setup and dismantling of the booth or its exhibits. Damage to exhibits and facilities due to fire, theft, robbery, water, and any kind of damage is not covered by the trade fair management's insurance. The trade fair management does not assume any custodial responsibility for exhibition goods and facilities and excludes all liability for damage or loss.
14. Liability exclusion of the trade fair management
The trade fair management is insured for its statutory liability. It does not assume any custodial responsibility for trade fair goods and booth facilities. Any liability for damage and loss is excluded. The booth staff and co-exhibitors should be made aware of the duty of care and custodial responsibility. Additionally, the exhibitor must take precautions against any loss of trade fair goods. Outside of opening hours, trade fair goods should be covered or, if necessary, securely locked. The liability exclusion is not limited by the security measures of the organizer. The trade fair management is not liable for the transport to and from the fair, as well as for the setup and dismantling. The trade fair management is not liable for claims made by exhibitors or third parties regarding the admission or non-admission of companies and/or services/products, among others.
15. Cancellation / Booth withdrawal
If an exhibitor cancels their participation in the exhibition after the contract has been concluded, they are fully liable for the booth rental and additional costs. If the trade fair management is able to re-rent the booth without damage, the exhibitor who withdrew from the contract must pay compensation amounting to 20% of the booth rental, with a minimum of CHF 500.00. In the case of a short-term cancellation (30 days or less before the start of the fair), the costs for the visual enhancement of the vacant booth (carpet, decorative plants, partition walls, etc.) will also be charged. The possibility of claiming further damages and handling expenses, such as for orders already placed (exhibitor directory, technology, furniture, ready-made booths, etc.), remains reserved. A cancellation 30 days or less before the fair must be done by registered letter; for other deadlines, a fax or email is sufficient, which will be confirmed with the cancellation fees (the confirmation is decisive).
16. Additional services
Additional services and services booked by the exhibitor (according to the detailed offer of SWISS CLASSIC WORLD), such as hostesses, booth construction, event services, etc., are offered and billed separately.
17. Payment deadlines and terms
All amounts invoiced by the exhibition management for booth spaces are due for payment immediately upon receipt of the invoice, without any deductions, within the payment deadline. Later-issued invoices are due in full immediately upon receipt without any deductions (except for booths in categories F and G, as well as invoices under CHF 300). Only when the contractually agreed payment terms have been met is the right to occupy the booth secured. Additional services and services booked by the exhibitor will be billed separately according to the offer and price list (see 'SWISS CLASSIC WORLD – Information & Services') and are due immediately upon receipt without any deductions. Any outstanding invoices for additional services, services, ancillary costs, etc., must be paid in cash by the booth staff during the fair.
18. Complaints
Any complaints related to events during the fair must be submitted in writing to the trade fair management at the trade fair office and must be endorsed by a member of the trade fair management during the event.
19. Violations of these conditions
In the case of violations of the exhibition conditions, the trade fair management may immediately close your booth and carry out the removal themselves, without the need for judicial intervention. This applies particularly to advertising that contravenes legal regulations, good morals, or the purpose of the fair, as well as advertising for ideological or political purposes. The exhibitor bears all resulting high costs in full.
20. Waiver of execution
In the event that unforeseen political or economic events or force majeure make it impossible or difficult to hold the fair, the exhibitor shall have no claims for damages or refunds.
21. Place of jurisdiction
The exclusive place of jurisdiction for all disputes that may arise in connection with the event is Luzern. If the wording of the translated exhibitor regulations in other languages leads to differences in interpretation, the German version shall prevail. All oral agreements and special provisions require written confirmation. The regulations of Messe Luzern AG and the fire safety regulations are integral parts of the contract with the trade fair management (subject to change). Exceptions are matters that are more strictly regulated in these conditions. All subsequent circulars and written notices are considered part of these regulations.
